Welcome to PitSwap Technologies Inc. ("PitSwap", "we", "our", or "us"). These Terms and Conditions ("Terms") govern your access to and use of the PitSwap website, mobile applications, and services (collectively, the "Service"). By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

1. About PitSwap

PitSwap is a marketplace platform facilitating the purchase and sale of new and used automotive parts. Unless explicitly indicated, PitSwap is not a party to any transaction between buyers and sellers. All transactions are conducted directly between users of the platform.

2. Eligibility

To use the Service, you must be at least 18 years of age and legally capable of entering into binding contracts. You agree to provide truthful, accurate, and complete information during the registration process and to maintain the accuracy of such information.

3. Prohibited Items and Listings

Are counterfeit, stolen, or fraudulent
Infringe any third-party intellectual property rights
Violate applicable laws or regulations (including but not limited to unsafe or illegal vehicle modifications and restricted materials)
Are subject to a government- or manufacturer-issued recall

PitSwap reserves the right to remove or disable any listing at its discretion that violates these or other platform guidelines.

4. Seller Responsibilities

Ensuring that listings are accurate, including descriptions and photographs
Clearly disclosing any defects, modifications, or conditions of the item
Honoring the listed price, shipping commitments, and any other terms of sale
Sellers must comply with all applicable local, provincial, and federal laws, including taxation obligations.

5. Buyer Responsibilities

Carefully review listings and seller terms prior to purchase
Ask clarifying questions if needed
Complete payment promptly and honor the terms agreed upon in the transaction

PitSwap does not guarantee the quality or authenticity of any item and encourages due diligence before purchasing.

6. Authenticity and Intellectual Property

You may not upload, use, or sell any content, trademarks, logos, or copyrighted materials unless you are the rightful owner or have legal authorization.
If you believe your intellectual property rights have been infringed on the platform, please contact us at info@usepitswap.com with sufficient details to support your claim.

7. Fraud Prevention and Identity Verification

We employ both automated and manual methods to detect fraudulent activity, including user verification protocols. You agree not to misrepresent your identity or provide false or misleading information. PitSwap reserves the right to suspend or terminate accounts suspected of fraudulent behavior.

8. Account Suspension and Termination

Violated these Terms
Engaged in repeated disputes or chargebacks
Posted or sold prohibited or harmful items

We will make reasonable efforts to provide notice and an opportunity to appeal unless immediate action is required for legal, fraud-prevention, or safety reasons.

9. Payments and Fees

PitSwap may charge service fees to buyers and/or sellers. Any applicable fees will be disclosed prior to listing or checkout. Sellers are responsible for all applicable taxes resulting from sales conducted through the Service.

10. Dispute Resolution Between Users

Buyers and sellers must attempt to resolve any disputes directly. If a resolution cannot be reached, either party may request mediation through PitSwap. While PitSwap may assist in dispute resolution, we do not guarantee refunds or outcomes unless otherwise required by law.

11. Limitation of Liability

Losses arising from item condition, shipping issues, or failed transactions
Unauthorized access to user accounts
Indirect, incidental, punitive, or consequential damages

Our liability, if any, is strictly limited to the amount paid to us for use of the Service.

12. No Warranty

Accuracy or reliability of listings or user content
Availability or uninterrupted operation of the platform
Conduct or actions of any third-party, including buyers or sellers

The Service is provided "as is" and "as available." PitSwap disclaims all warranties, express or implied.

13. Changes to the Service

We may modify or discontinue any aspect of the Service or these Terms at any time. Continued use of the platform after such changes constitutes your acceptance of the revised Terms.
